Small Claims Court

The Small Claims Court is a distinct branch of the Superior Court of Justice. It has civil jurisdiction for monetary claims up to $25,000. Some matters are heard by Small Claims Court judges who are appointed by provincial government. The majority of matters are heard by Deputy Judges who are lawyers that preside part-time in Small Claims Court and are appointed by the Regional Senior Judge with the approval of the Attorney General of Ontario.

The Small Claims Court Rules, came into force on July 1, 2006. The Rules are less complex to permit individuals to represent themselves. Self-help guides to procedures are available from the Ministry of the Attorney General of Ontario.

The Small Claims Court presides at over 90 sites in the province.
